General Terms and Conditions (GTC)

§ 1 Rental Property and Keys
(1) The landlord rents the following accommodation (“Rental Property”) to the tenant:

(2) The Rental Property is fully furnished and equipped and is rented with the following amenities:

Bed linen and towels
– are not included in the price.
– are available upon request for a fee.
Electricity costs based on consumption will be settled after the end of the holiday home stay upon return of the keys. Gas, water, and internet are included in the rental price.
(3) The tenant is entitled to use the following facilities during the rental period:
– The entire house (excluding the garage)
– All furnishings and appliances in the house
– All items in the garden, including the barbecue
(4) The tenant will receive a front door/apartment key for the duration of the rental period.
(5) The rental property is a non-smoking property.

§ 2 Rental Period, Arrival and Departure
(1) The rental property is rented to the tenant for the period from the arrival date to the departure date.
(2) Arrival takes place on the arrival date between 5 pm and 9 pm.
(3) Departure takes place on the departure date between 9 am and 11 am at the latest.
(4) At the end of the rental period, the tenant must vacate the rental property and hand it over to the landlord in a clean and tidy condition and return the key to the landlord/property manager.

§ 3 Rent, deposit and payment method
(1) The rental price is calculated per day for the duration of the rental period, plus a one-time final cleaning fee of €120 and, if applicable, a fee of €15 per person for towels and bed linen. Water, internet access, and gas are included in the total price. Electricity consumption will be billed separately upon key return at the end of your stay. Meter readings will be taken jointly with the landlord on-site at the beginning and end of your rental period.
A deposit of € 500 is to be paid in cash or by check on arrival and will be refunded after the rental period, minus any consumption costs.
(3) If the tenant defaults on payment for more than 14 days, the landlord is entitled to terminate the contract without notice and without further reasons and to rent the property to another party.
    
§ 4 Cancellation and early termination of stay
(1) If the tenant cancels (terminates) the contract before the start of the rental period without naming a replacement tenant who enters into the contract under the same conditions, the following pro rata rents (excluding final cleaning) are payable as compensation, taking into account any expenses saved, provided that alternative rental is not possible:
In the event of termination...
Up to 49 days before the start of the rental period: 10% of the rental price
Up to 35 days before the start of the rental period: 30% of the rental price
Up to 21 days before the start of the rental period: 60% of the rental price
Up to 14 days before the start of the rental period: 90% of the rental price
Otherwise (later than 14 days before the start of the rental period): 100% of the rental price.
Nevertheless, the landlord is making every effort to rent the property to someone else.
(2) If the tenant terminates the stay prematurely, he remains obliged to pay the full rental price.
Cancellations or terminations must be made in writing. The date of receipt of the declaration by the landlord is decisive.

§ 5 Liability and obligations of the tenant
(1) The rental property, including the furniture and other items located therein, must be treated with care. The tenant must ensure that persons accompanying and/or visiting him/her also treat the property with care. The tenant is liable for any damage to the rental property, its furnishings, or other items caused by him/her or persons accompanying him/her.
(2) Defects that arise upon taking possession of the rental property and/or during the rental period must be reported to the landlord immediately in a suitable form.
(3) Keeping dogs in the rental property is only permitted after prior agreement; the cost is €10 per day per dog and will be deducted from the security deposit.


(4) House rules: The tenant agrees to abide by the house rules. These are available in the rental property.

§ 6 Landlord's Liability Under Warranty
The landlord's strict liability under warranty for defects existing at the time of conclusion of the lease agreement is excluded. Section 536a Paragraph 1 of the German Civil Code (BGB) does not apply in this respect.

§ 7 Written Form, Severability Clause
(1) Amendments and supplements to this Agreement must be in writing. This also applies to any amendment of this written form clause.
(2) Should any provision of this Agreement be or become invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely approximates the economic purpose intended by the parties with the invalid or unenforceable provision.
(3) This Agreement shall be governed by the laws of the Federal Republic of Germany.
